By accessing or using ModaLearn (the "Service"), operated by ABJM Tech Corporation ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. If you are using the Service on behalf of an educational institution or organization, you represent that you have the authority to bind that entity to these terms.

2. Description of Service

ModaLearn is a multi-modal learning platform that transforms educational content based on individual learning preferences. The Service includes a web application, a Chrome browser extension, learning preference assessments, and AI-powered content transformation tools. The Service is designed for use by students, educators, and educational institutions.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

If you are under 18, you must have permission from a parent, guardian, or authorized school official to use the Service. Educational institutions that register students under 13 must obtain appropriate parental consent in compliance with COPPA.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Interfere with or disrupt the Service or servers connected to the Service

5. Chrome Extension

The ModaLearn Chrome extension is subject to these Terms and the Chrome Web Store's terms of service. The extension accesses webpage content only when you explicitly activate it. You acknowledge that the quality of content transformation depends on the source material and that results may vary. The extension is provided for educational purposes and should not be used to circumvent content access restrictions or copyright protections.

6. Intellectual Property

The Service, including its design, features, code, and content, is owned by ABJM Tech Corporation and is protected by copyright, trademark, patent (patent pending), and other intellectual property laws. ModaLearn™ is a trademark of ABJM Tech Corporation.

You retain ownership of any content you submit to the Service. By using the Service to transform content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the transformation service. We do not claim ownership of transformed content.

7. Educational Institution Agreements

Educational institutions that purchase district or enterprise licenses are subject to additional terms outlined in their service agreement. These may include data processing agreements, student data privacy addenda, and service level agreements. In the event of a conflict between these Terms and an institutional agreement, the institutional agreement shall prevail.

8. Subscription and Payment

Certain features of the Service may require a paid subscription. Pricing, billing cycles, and payment terms will be communicated at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled in accordance with our refund policy, available upon request.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, or secure.

ModaLearn is an educational tool designed to supplement, not replace, traditional instruction. AI-generated content transformations are approximations and may not always perfectly represent the source material. Users should verify critical information independently.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABJM TECH CORPORATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately, and we may delete your account data in accordance with our Privacy Policy.

12. Changes to Terms
